In a personally signed statement released on Thursday, Obidigbo expressed concerns that the EFCC appears to have become a political weapon used by desperate politicians and business rivals seeking to settle scores.
EFCC’s Legal Setbacks
He pointed out that the EFCC’s repeated failures in court indicate flaws in its operations.
“For the EFCC to keep losing so many cases in court shows that something is fundamentally wrong with its operational standards,” Obidigbo stated.
He further argued that the same constitution that grants governors immunity during their tenure does not empower the EFCC to subject them to post-service investigations.
Violation of Constitutional Oversight
Obidigbo criticized the EFCC for overstepping its constitutional boundaries, asserting that state legislatures, not external agencies, should be responsible for overseeing governors’ activities.
“The continued harassment of former governors contradicts constitutional provisions. In a presidential democracy like ours, oversight of the executive falls under the legislature, not an external body like the EFCC,” he said.
He also accused the anti-graft agency of unfairly targeting former governors, while former presidents, who enjoy the same immunity, are not subjected to similar scrutiny.
Security Votes and Financial Transparency
Obidigbo highlighted the constitutional opacity of security votes, noting that the “blind budget” provision allows governors discretion in their usage. He questioned why the EFCC is probing past expenditures when the constitution already empowers governors to manage these funds as they see fit.
“If the constitution permits governors to implement security budgets as they deem necessary, then the EFCC has no business chasing after these funds once they leave office,” he asserted.
Call for Legislative Action
He urged the National Assembly to intervene and prevent the EFCC from becoming a threat to Nigeria’s democracy by wielding unchecked power.
