The Department of State Services (DSS) had brought the firearm possession charge against Emefiele. However, Justice Oweibo struck out the charge due to insufficient diligent prosecution.
He highlighted that the actions of the Federal Government reflected a lack of respect for the court and a departure from lawful conduct.
Earlier, after hearing arguments, Justice Oweibo had granted Emefiele bail of N20 million with one surety in similar value. Despite the prosecution’s request to have Emefiele remanded in DSS custody, the judge ordered his confinement in prison custody.
Nonetheless, a dispute emerged as DSS personnel resisted prison officials from taking Emefiele. The ensuing altercation resulted in Emefiele being taken away by DSS, inciting various reactions.
