Filed By EndBadGovernance Organizer Against UBA For Blocking Access To FundsThe Take It Back (TIB) movement has filed a lawsuit against the United Bank for Africa (UBA) for freezing its account during the #EndBadGovernanceInNigeria protests. This legal action is outlined in suit number FHC/L/CS/1846/2024, submitted by the movement’s legal representatives, led by human rights lawyer Inibehe Effiong.

The TIB claims that the freezing of its account violates several provisions, including sections 44 and 46 of the 1999 Constitution of Nigeria and Article 14 of the African Charter on Human and Peoples’ Rights. In its originating motion, TIB requests the court to declare the account freeze unlawful and unconstitutional, asserting it infringes on the movement’s right to property.

The organization seeks several orders from the court, including:

1.A declaration that the freezing of its account (Account Number: 2109193911, Account Name: Take It Back) is null and void.

2.An order for UBA to immediately unfreeze the account.

3.A perpetual injunction preventing UBA from unlawfully interfering with the account in the future.

4.A demand for N100,000,000 (One Hundred Million Naira) in damages for the wrongful freezing.

5.An order to cover the costs of prosecuting the suit.

In an affidavit, Tomide Johnson, the TIB’s Southwest Coordinator, recounted that on July 26, 2024, he discovered the account was frozen and confirmed this with the movement’s founder, Omoyele Stephen Sowore. Johnson noted that the inability to access the account has severely hindered the movement’s financial transactions.

Despite efforts to contact UBA and resolve the matter, including a demand letter sent by their solicitor, the restrictions have not been lifted. Johnson expressed concern over rumors suggesting the account freeze was linked to the planned October 1, 2024, End Bad Governance protest. He stressed that since the account was frozen, the TIB has faced significant financial strain, including overdue bills and difficulties in carrying out its charitable objectives.

Johnson stated that the TIB is now forced to borrow money to meet its essential needs and is unable to fulfill its mission due to the continued inaccessibility of its funds.
