In two separate rulings, Justice Aikawa found that El-Rufai had not demonstrated any valid reasons that would justify overturning the court’s trial. The court also dismissed El-Rufai’s application for the judge’s recusal, citing a lack of substantial grounds as supported by precedent cases.

Rather than dismissing or striking out the suit as requested by the respondents’ counsel, the court chose to transfer the case to the Kaduna State Chief Judge for resolution by the High Court of Kaduna State, exercising its authority under Section 22(2) of the Federal High Court Act.

Femi Falana, SAN, and Sani Katu, SAN, represented the 1st respondent, while Sule Shuaibu, SAN, Attorney General of Kaduna State, and Jummai Danazumi, Esq., represented the 2nd respondent.

Following the judgment, some legal experts remarked that the ruling should be viewed as a reinforcement of the rule of law and judicial independence. “It sends a clear message that the judiciary remains steadfast against attempts to undermine the legal process,” they commented.
