The judge criticized the Ikoyi Custodial Centre for both lapses and delays in delivering justice to the defendant, who had spent eight years in prison custody before appearing in court.

Justice Oshodi pointed out that the case had been dismissed due to a lack of diligent prosecution by Justice Sybil Nwaka (retd) when the custodial centre failed to present the defendant for arraignment, despite the issuance of a reproduction warrant between 2016 and 2019.

“The defendant was held in the Ikoyi Custodial Centre for about eight years, from the day of his remand until his appearance before me on January 3, 2023, for arraignment. The proceedings revealed flaws in the operation of the Nigeria Correctional Service. It is astonishing to learn that the defendant was in Ikoyi Custodial Centre since 2016 but was only brought to court in 2023. The correctional centre bears direct responsibility for the defendant’s prolonged period of awaiting trial, and this is appalling.”

Justice Oshodi, in his verdict, affirmed that the prosecution successfully established the elements of defilement against the defendant with charge number LD/2359C/2016. The judge noted that the survivor, now 18 years old, testified that she was 13 when the incident occurred and that the convict served as a security guard at a construction site.

According to the survivor’s testimony, she went to fetch water at the construction site when the defendant forcefully assaulted her. The judge cited her account, stating, “The prosecutrix gave her testimony and said that she went to fetch water at the construction site where the defendant (convict) worked when he came from her back, closed her mouth, and found herself in the room with him. She said that the defendant ‘tore my clothe, and forcefully had sex with me, and I started having pains in my vagina. She testified further that she informed her parents about the incident, and her father reported the case at the nearest police station. The prosecutrix further told the court that she was taken to Mirabel Medical Centre for examination.”

Justice Oshodi emphasized that the survivor’s testimony was corroborated by her father, who served as Prosecution Witness Two. The judge found the survivor’s detailed and unwavering testimony credible.

“I believe her. The defendant’s denial does not hold water as he admitted knowing the prosecutrix but made a u-turn during cross-examination that he did not know her. He also admitted that the prosecution came to the compound to fetch water,” the judge remarked.

Justice Oshodi concluded by declaring Olarewaju guilty of the charge and imposing a life sentence on him. Additionally, the judge ordered that the convict’s name be entered into the Sexual Offences Register maintained by the Lagos State Government.
