According to Naija News, this approval follows the state government’s compliance with the amended Constitution of the Federal Republic of Nigeria and the Electricity Act 2023 (Amended). NERC’s statement highlighted that, as per the amended Constitution and the Electricity Act 2023, regulatory oversight of Kogi State’s electricity market has been transferred from NERC to KSERC.

Despite this shift, NERC will remain the primary regulator for inter-state and international electricity activities, including generation, transmission, supply, and trading. The Electricity Act of 2023 allows states to establish and manage their own intrastate electricity markets, provided they notify NERC and meet all legal requirements.

Kogi State, having fulfilled these requirements, formally requested NERC to transfer oversight of its intrastate electricity market to KSERC. In response, NERC issued an order outlining the transfer process. This includes instructing the Abuja Electricity Distribution Company (AEDC) to create a new subsidiary, AEDCSubCo, to handle electricity supply and distribution within Kogi State.

NERC has mandated that AEDC complete the incorporation of AEDCSubCo within 60 days from September 13, 2024, and that the new entity obtain a license for intrastate operations from KSERC. The deadline for completing all transfer processes is set for March 12, 2025.
