The court has since warned DSS Director General Adeola Ajayi that further restrictions on Kanu’s legal access could result in legal action, including imprisonment.
In an interview with Arise TV, Ejimakor shared that the threat of court action had spurred political interventions by figures such as Obi Agwoucha and Speaker Tajudeen Abbas. He indicated that he had received unofficial word that the DSS may be reconsidering its position and allowing access for Kanu’s legal team. Ejimakor explained that he submitted a letter with the names of the legal representatives slated to meet with Kanu, hopeful that the restrictions would be lifted. He added that if access remains restricted, the matter will proceed through legal channels.
Kanu is entitled to counsel access under Section 36 of the Nigerian Constitution. Ejimakor also argued that the DSS facility, a high-security holding cell, is not intended for prolonged detention and lacks the same standards and freedoms as a prison. “If DSS insists on holding him in their facility, they need to make necessary adjustments,” he noted, warning that failure to comply could lead to serious judicial consequences
