Presiding over the case, Justice G.V. Obomanu ruled that the congress must not hold in Cross River or any other location in Nigeria until the motion on notice is resolved.
The ruling was issued in response to a lawsuit filed by Tony Ejiogu, a PDP member from Ward 3 in Etche Local Government Area, and Field Nkoro, a former PDP Southeast Vice-Chairman. The defendants in the suit include the PDP and the party’s South-South National Vice-Chairman, Dan Orbih.
In the court order issued on Friday, the judge restrained the PDP, its agents, and affiliates from proceeding with the congress on February 22nd or any other date until a final determination on the motion on notice.
Status Quo to Be Maintained
The court directed all parties to maintain the status quo as of February 20th until further proceedings.
Additionally, the claimants were granted approval to serve the originating and subsequent court documents through substituted means, including:
- Pasting the documents at the gate of the PDP South-South zonal headquarters, located at Road 1, Plot 2A, Presidential Housing Estate, New GRA, Port Harcourt
- Publishing the court order in a widely circulated national newspaper.
