Mark Your Calendar: March 11 Court Hearing For N140bn Lawsuit Against Power Generating Firms

The N140 billion ground rent lawsuit against North-South Power Company Limited and Mainstream Energy Solutions Limited has been adjourned to March 11 by the Federal High Court 2, Minna. The defendants named in the writ of summons include Shiroro Hydro Electric Plc, North South Power Company Ltd, Kainji Hydro Electric Plc, Mainstream Energy Solutions, Federal Ministry of Power, and Nigeria Electricity Liability Management Limited.

During the court proceedings, Mohammed Ndayako, the plaintiff’s counsel, noted that Shiroro Hydro-Electric PLC, the third respondent, was absent despite being served the court processes. Additionally, he pointed out that the first defendant, the Federal Ministry of Power, failed to submit any processes, including a memorandum of appearance, despite the presence of its counsel in court. The counsel for the fourth respondent also filed responses beyond the stipulated time.

Lemu Aliyu, representing Mainstream Energy Solutions Ltd, informed the court that the third respondent, Kainji Hydro-Electric PLC, had been duly served with the court processes, as confirmed by the court’s registry.

Justice Abdullahi Dan-Ige, the presiding judge, adjourned the case to March 11, 2024, for further mention. This postponement aims to allow all involved parties to properly file and exchange court processes in accordance with legal procedures.
