EFCC Hits Back: Malami Failed Bail Conditions, Ignored Summons

In a statement on Saturday, the anti-graft agency emphasized that its operations are entirely apolitical. The clarification comes in response to allegations that Malami’s bail was revoked due to his involvement with opposition parties, particularly the African Democratic Congress (ADC).

The EFCC stated that Malami was granted provisional bail following his brief interrogation on November 28, 2025. However, he reportedly failed to meet any of the conditions attached to the bail or demonstrate readiness to comply with them.

The commission also noted that Malami received multiple invitations to appear for further investigations but did not attend, citing ill health. The EFCC clarified that it did not prevent him from giving media interviews and urged him to focus on fulfilling his bail obligations rather than engaging in misleading public statements.

The statement reads in part:

“The EFCC, though not inclined to engage in public disputes over its operations, is compelled to address the false claims by former Attorney-General and Minister of Justice, Abubakar Malami, SAN, regarding an alleged revocation of his bail over attending a political gathering in Kebbi.”

“Administrative bail is a temporary discretionary reprieve allowing a suspect to be released under specified conditions pending investigation and arraignment. After his brief interrogation on November 28, 2025, Malami was offered provisional bail contingent on five requirements, none of which he met or showed readiness to fulfill.”

“He was scheduled for further interrogation on December 1, 2025, but requested an adjournment citing ill health, which the Commission accommodated. He did not provide medical documentation or credible evidence of his condition. Consequently, he was re-invited on December 8, 2025, for additional questioning and detained until the bail conditions are satisfied.”

“The former minister’s claims that his bail was revoked or that the EFCC barred him from media interviews and political activities in Kebbi State are baseless. The Commission maintains no interest in the political affiliations of suspects and operates in an apolitical manner. It is noteworthy that even a former governor and senior ruling party member was recently arraigned for alleged contract fraud.”

“The EFCC advises Malami to focus on meeting the five bail conditions he acknowledged on November 28, 2025, and cooperate fully with investigators instead of making misleading claims in the media.”
