In a unanimous decision, Justices Theresa Ngolika Orji Abadua JCA, Fatima Omoro Akinbami JCA, and Hon. Justice Sybil O. Nwaka-Gbagi JCA upheld the decision of the High Court of Edo State. The ruling effectively dismissed the appeal of the appellant, Lucky Shauibu, who had claimed to be a member of the Labour Party in Ward 3 Executive of Esan North East, Edo State.

Justice Theresa Ngolika Orji Abadua JCA, in her lead judgment, emphasized the inability of one individual to unilaterally suspend the national chairman of the Labour Party. This decision aligns with Article 13 and 17 of the Party’s Constitution and the Electoral Act of 2022. The court’s ruling nullified the earlier suspension and all actions taken against Com. Julius Abure and the party arising from the purported suspension.

The verdict triggered swift reactions from key stakeholders. Comrade Julius Abure, elated by the outcome, commended the justices for their commitment to justice and acknowledged the team of dedicated lawyers, led by GC Igbokwe, SAN, for their unwavering support.

In his statement, Com. Julius Abure expressed gratitude towards the “Obidient movement,” a group that stood by him during the period of uncertainty. GC Igbokwe, SAN, the counsel representing Com. Julius Abure, praised the judgment and reaffirmed Abure’s position as the national chairman of the Labour Party until the party’s convention takes place.

President Aigbokhan, Esq, the lead counsel for the Labour Party, welcomed the Court of Appeal’s decision, considering it a landmark judgment that will resonate in the political landscape. He cautioned against associating with individuals purporting to be factional leaders, emphasizing the importance of parties as custodians of national conscience.
