This move comes ahead of the assembly’s scheduled plenary session on Tuesday, during which they are expected to decide the fate of the deputy governor, who has been accused of gross misconduct.
Last week, the assembly, under the leadership of Speaker Olamide Oladiji, adjourned their session until Tuesday after directing the Clerk of the house, Benjamin Jaiyola, to send a letter to the deputy governor regarding the allegations against him. The petition, signed by some lawmakers, was read during the previous plenary session.
In Suit No. AK/348/2023, filed at the High Court in Akure, the deputy governor is “seeking a declaration that the House of Assembly is not competent to proceed with his impeachment, which would breach his constitutional and fundamental rights to a fair hearing.
” He also argues that the removal of his media aides and subjecting him to the Ministry of Information headed by a Commissioner violates his rights and privileges as deputy governor.
Aiyedatiwa further seeks a declaration that his office, tenure, status, rights, and privileges are protected by the Constitution, and that he is entitled to a fair hearing in any determination of his civil rights and obligations as Deputy Governor of Ondo State by the House of Assembly.
He expresses concerns about potential bias in the impeachment process based on the conduct and statements of the House of Assembly thus far.
In response to the media trials against him, which occurred without any notice of gross misconduct being served to him, the Deputy Governor alleges that the House of Assembly has assumed the roles of accuser, investigator, prosecutor, and judge.
Aiyedatiwa is now requesting an injunction to prevent the House of Assembly from initiating, continuing, or proceeding with the process of his removal from office as Deputy Governor of Ondo State.
Additionally, he seeks an order to stop the Chief Judge of Ondo State from accepting or acting upon any request from the House of Assembly to establish a panel to investigate allegations of gross misconduct against him.
