In a press release issued on Saturday, Ejimakor highlighted that the Supreme Court also clarified that Kanu’s bail should not have been revoked. The context dates back to 2017 when Justice Binta Nyako of the Federal High Court in Abuja granted bail to Kanu, who was advocating for self-determination.
Following his release, Kanu’s home in Umuahia, Abia State, was invaded in September 2017, forcing him into exile, resulting in his absence from the subsequent trial dates. He returned to the country in June 2021 and has been undergoing trial since then.
Although the Appeal Court initially acquitted Kanu of terrorism charges, the Supreme Court later overturned this decision, transferring the case back to the Federal High Court. The recent Certified True Copy of the judgment from December 2023 explicitly stated that Kanu did not violate his bail.
Ejimakor commented on the matter, saying, “As Of Counsel, I had joined in this debate and always made it clear that Nnamdi Kanu, in the unique circumstance of the military invasion, did not jump bail.” He emphasized that the High Court of Abia State had earlier ruled in January 2022 that the military invasion violated Kanu’s constitutional rights.
In addition to confirming that Kanu did not jump bail, the Supreme Court ruled that the Federal High Court should not have revoked his bail. It also criticized the prosecution for deceiving the court on the bail-jumping issue and deemed the bench warrant leading to Kanu’s extradition as obtained through deception and should never have been issued.
Ejimakor urged the media, the public, and relevant officials to respect the Supreme Court’s judgment and cease spreading the false narrative that Kanu had jumped bail.
