In a statement released on Friday, APC National Publicity Secretary Felix Morka emphasized that the court did not declare APC a terrorist group, contrary to “highly erroneous media reports circulating.”

The party clarified that the case in question involved Douglas Egharevba and the Minister of Public Safety and Emergency Preparedness, in which Egharevba sought a judicial review of a Canadian Immigration Appeal Division (IAD) decision. The IAD had ruled that Egharevba was inadmissible to Canada under the Immigration and Refugee Protection Act (IRPA).

According to the APC, in the June 17, 2025 decision, Judge Phuong T.V. Ngo dismissed the judicial review application, noting that Egharevba was a member of the Peoples Democratic Party (PDP), which the court found engaged in subversive acts under paragraph 34(1)(b.1) of the IRPA. The judge did not make any finding against the APC.

The only mention of APC in the 16-page judgment appeared in the background section, where Egharevba claimed to have been a member of APC from December 2007 to May 2017. APC pointed out that the party did not exist until 2013, making Egharevba’s claim false.

The statement further clarified that the court never addressed terrorism, with Judge Ngo explicitly stating:
“Having found that the IAD’s analysis on subversion was reasonable, this is sufficient to dismiss the application for review. I will therefore refrain from analyzing the IAD’s findings on terrorism.”

APC described reports suggesting it had been declared a terrorist organization as “patently erroneous, if not mischievous,” stressing that such a claim is legally impossible, given that APC was not a party to the proceedings. The party urged Nigerians and its supporters to disregard these false and misleading reports.
