APC Takes Legal Action Against Aregbesola And INEC, Accusing Them Of Attempted Party Factionalization

In the suit numbered FHC/OS/CS/1/2024, dated January 4, 2024, the APC named the Independent National Electoral Commission (INEC), Hon. Rasheed Afolabi, and Lani Baderinwa as co-defendants. The party’s legal team, led by Ayodele Kusamotu and three others, requested the court to declare that Aregbesola is not legally authorized to lead suspended members in launching a political faction called Omoluabi Progressives within the party.

The APC sought the court’s order to prohibit the group’s activities, arguing that creating a factional political entity within the party, utilizing its logo, symbol, and slogan, goes against the constitution of Nigeria and the party’s internal constitution.

Among the reliefs sought by the party are:

1. Declaration that Aregbesola cannot lead suspended members or others to form a parallel political association within the party without proper registration with INEC.
2. An injunction restraining INEC from recognizing any congress or convention held by the suspended members and their associates for the purpose of constituting the party’s Executive Council or nominating candidates.
3. Prohibiting the illegal factional association named Omoluabi Progressives (APC) from impersonating the party’s registered logo, symbol, and slogan.

It is noted that Aregbesola had recently inaugurated the Omoluabi Progressives, expressing his dedication to the progressive ideals of the party.
