The Court of Appeal in Abuja has upheld the earlier decision by the High Court of the Federal Capital Territory (FCT) on April 27, directing Oyo State Governor Seyi Makinde to settle the outstanding balance of N3,374,889,425.60 from a total debt of N4,874,889,425.60. This debt originated from a Supreme Court judgment on May 7, 2021, against Makinde, the state’s Attorney-General, Accountant-General, and others in connection with the dismissal of All Progressives Congress (APC) elected chairmen and councillors in 2019…..CONTINUE READING
In a unanimous judgment, the three-member panel of the Court of Appeal criticized Makinde’s behavior, describing it as disrespectful to the nation’s judicial system. The court dismissed Makinde’s appeal, ruling it lacked merit, and imposed a cost of N50 million against him and the other appellants, payable to the former council chiefs.
The court emphasized that there was no dispute about the amount constituting the judgment debt, referring to a letter from the Attorney General of Oyo State on December 13, 2021, confirming the debt at N4,874,889,425.60. Justice Danlami Senchi highlighted that the state could not contradict itself by claiming the amount was not ascertained, especially when steps had been taken to make partial payments.
The court rejected the appellants’ argument that the ex-council chiefs should have obtained the consent of the Oyo State Attorney General before initiating garnishee proceedings, stating that such a requirement would be unfair to the judgment creditors. The ex-council chiefs had initiated the garnishee proceedings after the Oyo State Government failed to comply with the Supreme Court’s judgment.
In the April 27 ruling, Justice A. O. Ebong of the High Court of the FCT issued a garnishee order absolute, directing Makinde and others to pay the balance of the judgment debt in installments. The Court of Appeal affirmed this ruling, solidifying the obligation for Makinde to settle the outstanding amount.
