The panel of justices endorsed the decision of the State Election Petitions Tribunal, led by Justice Oluyemi Akintan Osadebay, which had earlier nullified Yusuf’s victory on September 20, 2023.
The tribunal declared Yusuf Gawuna of the All Progressives Congress (APC) as the legitimate winner of the March 18 governorship election in the state.
The tribunal invalidated 165,663 votes cast for Yusuf, citing the absence of signatures or stamps by the Independent National Electoral Commission (INEC).
Consequently, the governor’s vote tally was reduced to 853,939, while his APC rival, Nasir Ganuwa, maintained 890,705 votes.
Governor Yusuf contested the tribunal’s decision, deeming it “unfair” and a “miscarriage of justice,” leading to his appeal at the Court of Appeal. Wole Olanipekun, SAN, representing Yusuf, urged the court to overturn the tribunal’s judgment.
