Citing Section 109 (1) (g) of the Federal Republic of Nigeria Constitution, 1999 (as amended), the PDP argues that the seats of the 27 lawmakers have become vacant due to their departure from the PDP, the political party under which they were originally elected. According to the statement released by the PDP, Section 109 (1) of the Constitution mandates that a member of a House of Assembly vacates their seat if they “becomes a member of another political party before the expiration of the period for which that House was elected.”
The party insists that, in accordance with this constitutional provision and the Supreme Court’s interpretation, the 27 defected members have forfeited their seats along with all associated rights, privileges, recognition, and obligations.
The PDP is now calling on the Speaker of the Rivers State House of Assembly to promptly adhere to the constitutional mandate by declaring the seats of the 27 former lawmakers vacant. With the 27 constituencies now vacant, the PDP further demands that INEC conduct fresh elections within the stipulated period outlined in the Constitution.
The party issues a cautionary note, urging the former lawmakers to refrain from presenting themselves as members of the Rivers State House of Assembly, emphasizing that such actions could lead to charges of impersonation with serious criminal consequences.
