A Federal High Court in Port Harcourt has rescheduled the hearing for a lawsuit brought forth by members of the Rivers State Civil Society Organisation, who are seeking the removal of 27 lawmakers from the State House of Assembly. The hearing, originally slated for Friday, has been postponed until June 3, 2024, due to the unavailability of the presiding judge, Justice Stephen Daylop Pam.
The suit was initiated by the CSOs to seek clarification on Section 109 of the 1999 Constitution, particularly regarding the status of lawmakers who switched allegiance from the Peoples Democratic Party to the All Progressives Congress. The CSOs, led by Rivers State Chairman Enefaa Georgewill, are also seeking to prevent Governor Siminalayi Fubara from presenting the 2024 budget to the defected lawmakers.
Expressing disappointment over the extended timeline for the hearing, Enefaa Georgewill voiced concerns that the lawmakers’ legal counsel, led by Martin Amaewhule, might be employing delaying tactics. Georgewill emphasized the importance of the court’s decision in determining the lawmakers’ legitimacy in the State House of Assembly, reiterating that justice would ultimately prevail despite any attempts to obstruct the legal process.
The Chairman underscored the significance of the matter, highlighting its alignment with Supreme Court precedents. He urged the lawmakers to engage with the legal proceedings transparently, emphasizing the importance of the court’s role in resolving the dispute.
