The Federal High Court in Yenagoa, Bayelsa State, has mandated the Economic and Financial Crimes Commission (EFCC) to compensate Pastor Oyinmiebi Biribena and his wife, Pastor Beatrice Biribena, with N10 million in damages for prematurely declaring them wanted, sans a legitimate court order. According to Naija News, Justice Dashen presided over the case, deeming the EFCC’s actions unjust, unlawful, and unconstitutional.
Initially, the plaintiffs sought N100 million in damages, but the court deemed N10 million as exemplary damages. The saga ensued when the EFCC issued a notice on June 8, 2022, flagging the couple as wanted. Responding swiftly, the Biribenas lodged a lawsuit on June 10, 2022, aiming to safeguard their fundamental human rights.
The court’s verdict underscored the publication’s infringement on the couple’s rights to personal liberty, freedom of movement, and dignity, as enshrined in the Nigerian Constitution and the African Charter on Human and Peoples Rights. Justice Dashen, in his judgment, emphasized the EFCC’s violation of constitutional safeguards and mandated the agency to publicly apologize to the couple for the wrongful publication.
Furthermore, the court restrained the EFCC from extending invitations, harassment, arrests, or detentions of the Biribenas, pending the resolution of another lawsuit involving Bliss Multinational Perfections Limited and the EFCC.
