The Community Court of Justice of the Economic Community of West African States (ECOWAS), seated in Abuja, has ruled that the government of the Republic of Benin must pay Yoruba nation activist Chief Sunday Adeyemo, popularly known as Sunday Igboho, a sum of 20 million CFA for unlawful detention and violation of his fundamental human rights. The unanimous judgment, delivered on Tuesday, December 5, by Justices Gberi-Bé Ouattara, Sengu M. Koroma, and Ricardo Claúdio Monteiro GONÇALVES, ordered the Republic of Benin to ensure the payment of the specified amount within three months of the judgment’s delivery.

In the case marked ECW/CCJ/APP/15/22, Chief Sunday Adeyemo (aka Sunday Igboho) vs. Republic of Benin, the court also instructed the Francophone country to comply with the order and provide evidence of payment within the stipulated three-month timeframe.

Representatives for Chief Adeyemo included Tosin Ojaomo, Aderemilekun Omojola Esq., Dr. Janet Fashakin Esq., and Irene Aclombessi, who represented the Republic of Benin.

The judgment stemmed from an application filed by Adeyemo challenging his arrest and detention in Benin Republic on July 21, 2021. The application was submitted to the ECOWAS Court in Abuja on February 10, 2022. CONTINUE READING

The court documents outlined the orders sought by Chief Adeyemo, which included an expedited procedure for his imprisonment and release, an order for his immediate and unconditional release along with his Nigerian passport, and any other orders the court deemed fit.

Recall that Igboho and his wife, Ropo, were arrested on July 20, 2021, in Cotonou, Benin Republic, at the request of the Nigerian government. The Yoruba nation agitator had fled Nigeria after a raid on his residence by a combined team of the Nigerian Army and the Department of State Services (DSS) on July 1, 2021.
