Obiano, who was apprehended on March 17, 2022, at the Murtala Muhammad International Airport in Lagos while attempting to travel to Houston, USA, is accused of misappropriating public funds, including N5 billion from the Subsidy Reinvestment and Empowerment Programme (Sure-P) and N37 billion designated as security vote, withdrawn in cash.

The Economic and Financial Crimes Commission (EFCC) alleges that part of the funds was diverted to support political activities in the state, and Obiano had been under the EFCC’s scrutiny for some time due to corruption allegations.

A charge filed at the Federal High Court in Abuja reveals that the EFCC plans to prosecute Obiano on nine counts, focusing on illegal withdrawal of security vote and money laundering. Sylvanus Tahir, SAN, will lead a team of eight other lawyers in the trial.

According to court documents, Obiano is accused of unlawfully transferring N4,008,573,350 from security votes into various accounts, converting it into dollars, and receiving it in cash. Among the charges, it is stated that Obiano indirectly transferred sums from the Anambra State Government Security Vote Account into accounts of entities unrelated to the state government, dissipating funds for purposes unrelated to security affairs, thereby violating the Money Laundering (Prohibition) Act, 2011.

The charges detail specific instances, such as the transfer of N156,800.00 and N261,268,585.00, highlighting the alleged illegal movement of funds through his then principal private secretary, Mr. Willie Nwokoye. The charges accuse Obiano of committing offenses contrary to Section 15 (2) (b) of the Money Laundering (Prohibition) Act, 2011 (as amended) and punishable under Section 15 (3) of the same Act.

The former governor is set to face a legal battle as the EFCC seeks to establish his culpability in the alleged financial impropriety during his time in office.
