Firm To Pay N13.95 Million To Businessman For Breach Of Contract, Court Rules

Justice Chinyere Nwecheonwu also ordered the company to pay an additional N10 million in general damages for the breach.
Unini, an Abuja businessman, had purchased a brand new, fully functional 22.5 KVA Perkins soundproof generator from M. Saleh & Co. Ltd in December 2021, intending to use it as an alternative power source to keep perishable goods fresh during outages. He paid N3.95 million, and the generator was delivered and installed on December 3, 2021.
However, within weeks, the generator began malfunctioning and failed to power on when needed. Despite multiple repair attempts by the company’s technicians from December 2021 to March 2022, the generator remained dysfunctional.
Frustrated, Unini, through his lawyer Ikogwe Eugene, demanded a replacement or a refund in a letter to the company on May 30, 2022. When the company failed to comply, Unini filed a lawsuit.
During the proceedings, M. Saleh & Co. Ltd claimed the generator’s issues were due to a lack of diesel and the use of adulterated diesel supplied by Unini. However, the company failed to provide credible evidence to support these claims.
