Members of the House of Representatives known as G-60 clarified that the recent Court of Appeal judgment regarding the Rivers State House of Assembly did not reinstate the 27 lawmakers who were previously dismissed.
The group emphasized that the Appeal Court did not overturn the dismissal of the 27 lawmakers, contrary to some interpretations. This clarification was made by the group’s leader, Ikenga Ugochinyere, during a press briefing on Thursday.
Previously, the Rivers State High Court had ruled that the 27 lawmakers, who were aligned with former Governor Nyesom Wike and had defected from the PDP to the APC, lost their seats due to this defection. However, the Court of Appeal’s recent decision addressed the jurisdiction of the Rivers State High Court in this matter without delving into the legality of the lawmakers’ defection or the status of their seats.
Following the Appeal Court’s ruling, Ugochinyere stated, “Today’s ruling by the Court of Appeal should not be misinterpreted. The seats of the pro-Wike lawmakers remain vacant as the Appeal Court did not rule on the legality of their defection or the declaration of their seats as vacant.”
He further explained, “The Appeal Court specifically declared that the Federal High Court holds jurisdiction to determine the legality or illegality of defections, thereby rejecting the proceedings of the Rivers State High Court in this regard.”
