Herbalist Kasali Yinusa has implored the Mapo Grade ‘A’ Customary Court in Ibadan to terminate his nine-year matrimony with his estranged wife, Abosede, citing her alleged adulterous behavior and its negative impact on their daughter. Yinusa voiced his distress about the immoral influence Abosede has had on their child, leading to disruptive behavior during visits. He further accused Abosede of wastefulness, claiming that despite stocking her shop with goods, she recklessly squandered the proceeds.
Seeking custody of their child, Yinusa appealed to the court for intervention. In response, Abosede, a trader, argued that Yinusa had not fulfilled his responsibilities as a father, neglecting to pay their child’s school fees. She claimed that this financial strain led her to seek divine intervention in church.
Abosede detailed instances of alleged physical abuse by Yinusa, stating that he became angered when she couldn’t meet his financial demands. Additionally, she revealed that she was Yinusa’s sixth wife, and he married another woman while she was three months pregnant.
The court’s President, Mrs. S.M. Akintayo, delivered the judgment, asserting that there was no traditional marriage to dissolve since neither party mentioned the payment of bride price or the exchange of gifts—essential elements in traditional marriages. She emphasized that mere cohabitation and having children did not constitute a valid marriage.
Granting custody of the seven-year-old child to Abosede, the judge reasoned that she was better positioned to care for the child. An order was issued to restrain Yinusa from harassing, intimidating, or interfering in the petitioner’s personal life moving forward.
