Cole had contested the victory of Fubara and his declaration as the winner in the March 2023 governorship election in the state, conducted by the Independent National Electoral Commission (INEC).
Present in the courtroom on Tuesday, the APC candidate sought the court’s intervention to instruct INEC to declare him the winner of the March gubernatorial election in Rivers.
In October, the Rivers State Governorship Election Petition Tribunal had already rejected Cole’s petition, which challenged Fubara’s election as the state governor.
The tribunal cited the withdrawal of the petition by the APC, Cole’s sponsoring party, as the basis for the dismissal.
Unsatisfied with the Tribunal’s decision, the APC candidate then pursued the matter further by approaching the Court of Appeal.
