The panel of three judges, led by Justice Biobele Georgewill, ruled that the appeals against the senators were without merit.

Following the declaration by the Independent National Electoral Commission (INEC) on February 25, affirming Ndume and Lawan as winners of their senatorial district elections, challenges were raised by Muhammed Kumalia and the Peoples Democratic Party (PDP) against Lawan, while Kudla Satumari and the PDP contested Ndume’s election.

The state’s election tribunal dismissed both petitions, leading Kumalia and Satumari to file appeals at the Court of Appeal, detailed in appeal numbers CA/G/EP/SEN/BR/7/2023 and CA/G/EP/SEN/BR/04/2023, respectively.

Representatives including Yusuf Ali, SAN, for Kaka Shehu and APC, Johnson Usman, SAN, for INEC, and Marcel Oru, SAN, for Ndume, argued against the appeals, urging the court to dismiss them.

The Court of Appeal concurred with the arguments of the respondents’ counsel, ruling that the appeals lacked merit and upheld the election victories of Lawan and Ndume.
