Emmanuel, through his attorney, Mr. Charles Mekwunye, SAN, alleged that Enang, a former presidential adviser to ex-president Muhammadu Buhari on National Assembly and Niger Delta Affairs, defamed his character by stating in the press that Emmanuel’s administration is the “Worst in the history of Nigeria.”
Mekwunye argued in court that the defendant’s false and malicious statements, made on Lagos Talks FM (91.3) on December 29, 2018, severely damaged Emmanuel’s reputation in the eyes of the public, causing continuing and irreparable harm to his personality, professional standing, and political image both in Nigeria and internationally. The former governor sought an order for Enang to pay N1,000,000,000.00 (One Billion Naira) as compensation for the alleged injury and damage suffered.
In response, Enang’s lawyer, Mba Ukweni, a Senior Advocate of Nigeria, filed a preliminary objection challenging the competence of the suit and the court’s jurisdiction. Ukweni argued that the claimant’s attorney, Mr. Ekerete Udoh, lacked the authority and capacity to initiate the action on behalf of the claimant. Additionally, he contended that Lagos Talk FM, the media house where the alleged defamatory statement was made, was not joined as a defendant, rendering the necessary parties absent.
Ukweni further asserted that the statement “Udom’s government is the worst fraudulent government in this country” does not establish a cause of action in favor of the claimant, and the document containing the libelous publication was not properly submitted in compliance with court rules.
The defendant’s lawyer urged the court to dismiss the suit on grounds of incompetence and lack of jurisdiction. Justice Olukayode Adeniyi heard the arguments from both sides and adjourned the case to March 5, 2024, for the ruling on the preliminary objection.
