The Supreme Court, in a unanimous decision by a five-member panel of Justices, has reinstated Governor Abba Yusuf of the New Nigeria Peoples Party (NNPP) as the rightful winner of the governorship election held in Kano State on March 18. Justice Inyang Okoro, delivering the lead judgment, emphasized that the two lower courts erred in deducting valid votes credited to Governor Yusuf by the Independent National Electoral Commission (INEC). The Supreme Court declared that the 165,663 votes deducted from Yusuf and the NNPP, allegedly due to unsigned, unstamped, or undated ballot papers, were indeed valid.
Contrary to the lower courts’ stance, the Supreme Court clarified that 146,292 of the contested ballot papers were confirmed to have been signed and stamped, albeit lacking a date. The court invoked section 63(1) of the Electoral Act 2022, asserting that ballot papers with the official mark issued by INEC were not entirely invalid. Additionally, the court found no evidence that Governor Yusuf influenced the non-signing of the ballot papers.
The Supreme Court criticized the lower courts for annulling Yusuf’s election based on the claim that he was not a member of the NNPP. It maintained that the sponsorship of a candidate in an election falls within the domestic affairs of a political party. The court affirmed that Yusuf secured the governorship election with the majority of lawful votes and was duly nominated by his political party, NNPP.
