NCAA Breaks Silence: Why Kenya Airways Can’t Be Banned Despite Rising Tensions

Michael Achimugu, NCAA’s Director of Public Affairs and Consumer Protection, disclosed this on Saturday while addressing complaints lodged by Nigerian passengers against the airline, including the case of Gloria Omisore.
Achimugu highlighted that Kenya Airways mishandled Omisore’s complaint and astonishingly claimed ignorance of NCAA regulations. “The Kenya Airways team stated they had no copy of the NCAA regulations. We will be sending them one. But how can an airline operate in a foreign country without adhering to its aviation laws? It’s like blaming Omisore for not knowing the required travel documents for her trip,” he remarked.
To address this, Achimugu revealed that NCAA will organize a retreat for all airlines operating in Nigeria to reinforce understanding of Part 19 of the NCAA Regulations 2023. “It’s expected that airlines are familiar with the regulations governing their operations.”
Citing numerous unresolved cases—ranging from unpaid refunds, unaddressed lost baggage claims, and failure to meet commitments—Achimugu expressed the NCAA’s frustration with Kenya Airways’ conduct. “The NCAA is initiating strict enforcement actions against Kenya Airways. The process will follow due legal procedures, and our legal department is already on alert,” he said.
When questioned by a Nigerian X user about why Kenya Airways hasn’t been banned, Achimugu clarified that diplomatic ties between Nigeria and Kenya play a role. “Anyone can choose not to fly with a particular airline. Sanctions are not designed to punish but to enforce compliance, ensuring passenger safety and better travel experiences.”
He added that Kenya Airways operates ten weekly flights into Lagos, sometimes running two flights a day, emphasizing the strong bilateral relations between the two nations.
