Speaking to Daily Post, NCAA spokesperson, Michael Achimugu, explained that Emmanson’s case proceeded to court because Ibom Air, the affected airline, exercised its legal right to sue her directly.
Emmanson was arraigned and remanded on Monday, a move that stirred public debate and led Labour Party’s 2023 presidential candidate, Peter Obi, to accuse authorities of applying double standards.
Achimugu clarified that in KWAM1’s case, the airline involved, ValueJet, chose not to sue him. Since the NCAA lacks prosecutorial powers, the agency opted to refer KWAM1’s matter to the Attorney General and the Inspector General of Police for further action.
“In Comfort Emmanson’s case, the airline immediately had her arrested and charged to court,” Achimugu said. “Once that happens, the NCAA has no further role. But in the KWAM1 case, because the airline did not take him to court, the NCAA stepped in by referring it to the proper authorities.”
He stressed that had ValueJet initiated court proceedings against KWAM1, the NCAA would not have been directly involved in the matter.
