The association, acting on behalf of itself and 169 individual traders, has asked the Lagos State High Court at Tafawa Balewa Square to rule that the demolition of the kee-klamp structures they occupied was wrongful, unlawful, and unconstitutional. Additional claims in the lawsuit have been filed by Babro Ventures Limited and Tosh Limited.
The defendants in the case include the Lagos State Attorney General, the Lagos State Building Control Agency, the Ministry of Physical Planning and Urban Development, the Lagos State Development and Property Corporation, and the Lagos State Urban Renewal Authority.
In a 42-paragraph statement attached to the suit, the claimants detailed that they had peacefully occupied the kee-klamp structures and conducted their businesses until April 17, 2024, when officials from the Lagos State Building Control Agency issued a threat to demolish their shops without prior notice. In response, the claimants instructed their lawyer to send a letter on April 18, 2024, requesting the defendants recognize that they were not illegal occupants and expressing concern about the hardship the demolition would cause.
The traders also explained that they followed up by meeting with the Special Adviser to the Governor on Physical Planning on April 18 and 19, 2024, where they were reassured that the demolition would not take place. Despite these reassurances, the traders claim the demolition was carried out, prompting their legal action.
