In Abuja yesterday, a Federal High Court directed the remand of Prof. Cyril Ndifon, the suspended Dean of the Faculty of Law at the University of Calabar, UniCal, who is facing allegations of sexual harassment. The ICPC, represented by counsel Ebenezer Shogunle, filed the charges on Oct. 30, 2023, accusing Ndifon of various offenses. In the first count, he was charged with using his position to solicit nude photographs and videos from a second-year diploma female student between June and September 2023. This act was deemed a violation of Section 19 of the Corrupt Practices And Other Related Offences Act, 2000.

The second count accused Ndifon of corruptly requesting explicit content from a 400-level female student with the intention of influencing her project supervisor assignment for favorable grades. This act was stated to be contrary to Section 8(1)(a) (il) of the ICPC Act. The third count alleged Ndifon’s corrupt request to see photographs of a 16-year-old prospective post-UTME female student as an inducement for possible admission into the Faculty of Law, contravening Section 18(d) of the Act.

The fourth count accused Ndifon of causing a female student to send explicit photographs through WhatsApp chats between May and September 2023, violating Section 24 of the Cybercrime (Prohibition & Prevention) Act, 2015. These charges were claimed to have occurred during Ndifon’s tenure as a public officer responsible for certifying students’ fitness in learning and character for the award of a Bachelor’s degree in Law and admission into the Nigeria Law School.

Upon hearing the charges, Ndifon pleaded not guilty. His counsel, Okon Efut, SAN, presented a bail application on Jan. 3, emphasizing his client’s health condition and the imminent need for eye surgery due to Glaucoma. Ndifon mentioned from the dock, “My lord, I was supposed to have an eye surgery on Glaucoma.” Efut argued that Ndifon had been granted bail by a magistrate court in Calabar on Oct. 27, 2023, based on his health condition, with the surgery scheduled for Jan. 11.

ICPC Lawyer, Osuobeni Akponimisingha, opposed the bail application, stating that they received the medical report late and were still verifying its authenticity. Justice Omotosho, expressing concern over the delay in the surgery, ordered Ndifon’s remand in Kuje Correctional Centre. The court scheduled the hearing of the bail application for Jan. 10.
