The Sokoto State government has asserted that the Sultan of Sokoto lacks authority to make appointments under the existing Chieftaincy law, citing it as contradictory to the Nigerian constitution. Speaking at a public hearing on Tuesday, Commissioner of Justice Barrister Nasiru Binji highlighted that Section 76(2) of the Sokoto Local Government and Chieftaincy Law 2008 conflicts with Section 5(2) of the 1999 Constitution as amended.

Binji emphasized, “Section 5(2) of the constitution vests executive power to appoint in the Governor directly, through deputies, commissioners, or designated government agents. Hence, there is no provision granting the Sultanate Council appointment powers.” He further explained that while Section 76(2) allows the Sultanate Council to appoint district and village heads with the Governor’s approval, this provision contradicts the constitutional mandate.

Concluding, Binji stated, “The power to appoint is executive in nature, vested solely in the Governor. The amendment seeks to rectify past errors and ensure constitutional compliance.”
