In the ongoing legal dispute over the Kano emirate, the legal team representing the 15th Emir of Kano, Aminu Ado Bayero, has withdrawn from the case before the Kano State High Court. This decision follows the court’s refusal to grant a stay of proceedings, which has caused dissatisfaction among the legal representatives.
During a recent court session, Abdul Muhammed, SAN, counsel for the first respondent, expressed concerns about the trial progressing despite a pending motion of appeal and notice of stay of proceedings at a higher court. He argued that proper procedural steps should have been followed concerning the dependency on the higher court’s decision.
Despite requesting an adjournment to respond adequately to court processes served that morning, Muhammed’s plea was denied by the court. Subsequently, both Muhammed and another senior member of the legal team, Barrister Sanusi Musa, SAN, announced their withdrawal from representing the first respondent in the case.
Various submissions were made by other parties involved in the proceedings. Hassan Tanko Kyaure, representing the third, fourth, and fifth respondents, filed for an extension of time and urged the court to set aside the repeal of the law by the Kano State Emirates Council, citing procedural irregularities, and requested the dismissal of the application with a cost of N1 billion.
On the other hand, Sunday Ekwe, counsel for the sixth respondent, left the matter to the court’s discretion without further argument.
The applicant’s counsel, Eyitayo Fatogun, opposed the motion for affidavit of facts, alleging it was a delay tactic. He emphasized that the focus should be on addressing pending applications and urged the court to dismiss the application related to the repealed law as irrelevant to the current proceedings.
Presiding over the session, Justice Amina Adamu Aliyu declined the application for a stay of proceedings, stating that it did not conform to court rules and lacked sufficient special facts to justify a stay.
The case has been adjourned to July 18 for the court to rule on various applications, including the extension of time and preliminary objections.
This legal battle involves a motion filed by the Attorney General of Kano State, the Speaker of the Kano State House of Assembly, and the Kano State House of Assembly. They seek to restrain Aminu Ado Bayero and four other dethroned emirs from acting as emirs.
The case has garnered significant attention due to its potential implications for the traditional leadership structure in Kano. The respondents include Alhaji Aminu Ado Bayero and other affected emirs, along with several security agencies as respondents.
