Emefiele’s Release: EFCC Fails To Comply With Court Order

The EFCC claimed confusion in the interpretation of the court order, but Justice Olukayode Adegbola Adeniyi rejected this explanation.
He reaffirmed his order that Emefiele be released on bail or produced in court on November 8 and warned that flouting the order would have consequences.
During the hearing of Emefiele’s fundamental rights enforcement suit, his counsel, Mathew Burkaa, complained that the EFCC had not obeyed the court order since November 2.
The EFCC lawyer, Farouk Abdalla, admitted that his client had received the release order but claimed there was slight confusion in it.
Justice Adeniyi emphasized that the order was clear and free from ambiguity, and he ordered the EFCC to obey it.
Abdalla apologized for the failure to comply with the order and assured the court that the EFCC would adhere to all lawful orders.
Justice Adeniyi ordered that the existing order must be obeyed before the motion on notice could be heard. The EFCC was given until November 8 to produce Emefiele in court for the purpose of admitting him to bail.
Counsel to the Federal Government and the Attorney General of the Federation, Oyin Koleoso, noted that some vital documents in Emefiele’s affidavit were missing from the processes served on his clients, and the court ordered the plaintiff’s lawyer to rectify the discrepancies before the adjourned date.
