Ezechinoso, a resident of Onitsha, Anambra State, was accused of obtaining a customized and sensitive registration material from the Anambra State office of the Joint Admissions and Matriculation Board (JAMB) for the purpose of initiating UTME registration. However, he allegedly concealed the material with the intention of defrauding the board.
JAMB, in a statement released on Sunday, expressed satisfaction with the court’s decision. The board also pledged to pursue the prosecution of a separate case involving the violation of the data protection rights of a 15-year-old candidate by a CBT Centre agent, which is currently before a Lagos Court.
The statement, issued by JAMB spokesperson Fabian Benjamin, outlined the details of Mr. Ezechinoso Augustine’s conviction. According to the statement, the accused, operating a CBT centre in Onitsha, faced charges of criminal breach of trust, concealment, registration infraction (cheating), and theft.
During the hearing on Monday, February 6, 2024, Ezechinoso pleaded guilty to the charges, as confirmed by prosecuting counsel Mr. Olisaemeka Okeke. The defendant’s counsel, Barrister Pere Adge, argued that Ezechinoso, being a first-time offender and a Nigerian possibly influenced by prevailing circumstances, should be shown mercy.
However, the presiding judge, Hon. Aliyu Ibrahim Kagarko, found the suspect guilty. Ezechinoso was remanded at Nasarawa Correctional Centre until Thursday, February 8, 2024, for judgment, which was later postponed to Friday, February 9, 2024.
On the following day, the judge pronounced Ezechinoso guilty on all four counts, including criminal breach of trust, concealment, intent to conceal, and theft. The penalties included imprisonment terms ranging from three to nine months and fines ranging from ten to thirty thousand naira.
JAMB welcomed the judgment, cautioning potential offenders to refrain from illicit activities, emphasizing its commitment to using technological devices for real-time detection of infractions. The board asserted its determination to protect its systems and clients from any form of violation.
Additionally, JAMB reiterated its zero tolerance for statutory violations and assured the public that it would pursue justice in the reported data protection violation case involving a 15-year-old candidate before a Lagos Court.
