Principal Magistrate Agnes Mwangi granted the release of William Ovie Opia and Johnbull Asbor on February 15, 2024, while awaiting the results of the DNA test, which had been authorized by the court on January 31. The police were given 21 days to collect DNA samples to compare with the deceased.
During the court session on Thursday, Magistrate Mwangi was informed that investigations had been concluded, with only the pending DNA test remaining. The suspects, represented by their lawyer Victor Obuli, requested release and the return of their phones.
The magistrate ordered the pair to report to the Directorate of Criminal Investigations (DCI) every Wednesday until the DNA test results are available. Additionally, the police were instructed to return the suspects’ phones.
According to the DCI’s investigations, the two Nigerians were residing in Kenya illegally. Asbor claimed to have lost his passport two years prior. Detectives from the DCI’s Criminal Research and Intelligence Bureau traced the suspects to an apartment in Ndenderu, Kiambu County.
Constable Benjamin Wangila of Kasarani DCI offices had previously informed the court that the suspects were living near the area where Rita Waeni’s head was found. The police recovered various items from their residence, including a hatchet, butcher’s knife, a Kenyan national identity card (name withheld), six mobile phones, three laptops, and 10 SIM cards from different providers.
The investigation team sought permission to obtain call data records for the recovered SIM cards and mobile phone numbers to determine if the suspects were involved in the murder. Wangila stated that the suspects were flight risks due to their lack of a known fixed abode.
The court set March 14, 2024, as the date for the next mention of the case to confirm the outcome of the DNA tests. Rita Waeni Muendo was laid to rest in a private ceremony at her parents’ home in Mukimwani Village, Kisau location, Makueni County, on February 5.
