The appeal was contained in a letter dated April 28, 2026, submitted by lawyers representing a faction linked to former Senate President David Mark. The legal team warned that prolonged delay in the court’s decision could jeopardise the party’s participation in the 2027 general elections.

The Supreme Court, which heard the case on April 22, 2026, had reserved judgment without setting a date. The matter is before a five-member panel led by Justice Mohammed Garba, following appeals challenging earlier rulings from lower courts on the party’s leadership crisis.

In the letter addressed to the Chief Justice, the lawyers stated that actions already taken by the electoral authorities—based on prior court rulings—have left the ADC without recognised leadership, despite its continued registration as a political party.

They warned that further delay in the judgment could prevent the party from meeting key requirements for participation in the 2027 elections, potentially leading to its exclusion.

According to the letter, failure to deliver a timely ruling could have serious consequences for the party and its supporters, arguing that millions of Nigerians affiliated with the ADC risk being disenfranchised and denied the right to participate in the electoral process through their preferred political platform.

While acknowledging the workload of the Supreme Court, the lawyers stressed that in this situation, delay in justice would effectively amount to denial of justice, adding that the political future of the party and the expectations of its members now hang in the balance.
