The decree was passed on September 19 by Judge Jeffrey Gilbert of the United States District Court. He mandated the university to furnish Mr. Abubakar with Mr. Tinubu’s records as an integral part of an ongoing electoral dispute in Nigeria. As part of the order, the university administrators were also directed to verify the authenticity of all disclosed records under oath.
Despite the court’s directive for the documents to be provided by September 21, Mr. Tinubu’s legal team has taken urgent action to halt the release. In a move to defer the execution of the order until September 25 at the earliest, they have filed an appeal.
Mr. Tinubu’s legal counsel, spearheaded by Christopher Carmichael, stated, “Given the imminent deadline set by Chicago State University, Mr. Tinubu is presenting this motion separately from his challenge to the Magistrate’s prior decision.” They added that a detailed brief highlighting the discrepancies in the Magistrate’s decision would be filed by the day’s end. A prompt hearing on the situation has been scheduled by Judge Nancy Maldonado at 3:00 p.m. local time. All involved parties, including representatives from CSU and lawyers for both Mr. Tinubu and Mr. Atiku, are anticipated to participate in the virtual meeting.
