Justice D.H. Khobo delivered the ruling on April 21, 2026, in a case brought by the Federal Republic of Nigeria through the Independent Corrupt Practices and Other Related Offences Commission (ICPC). The court held that the circumstances of the case did not justify granting bail at this stage.
In his application, El-Rufai had sought release on self-recognisance or on any conditions the court deemed appropriate. He argued that the charges were non-capital and therefore bailable, insisting that his strong community ties, fixed residence, and assets made him unlikely to abscond. He also told the court he voluntarily returned from Egypt to face questioning, describing the charges as defective and unclear, while citing health challenges requiring specialist care.
However, the ICPC opposed the application, describing the alleged offences as economically damaging and warning that the former governor could tamper with witnesses or disrupt ongoing investigations involving other suspects. The agency also alleged obstruction of law enforcement officers at the Nnamdi Azikiwe International Airport in February 2026 and dismissed his health claims due to lack of supporting medical evidence.
In his ruling, Justice Khobo stressed the seriousness of the charges and upheld the prosecution’s concerns, stating that justice would be better served by ensuring the defendant remains available for trial. He also noted that no credible medical evidence had been provided to support the health claims.
The judge therefore refused the bail application and ordered that El-Rufai remain in ICPC custody pending trial. He also directed that the case be heard on an accelerated basis, scheduling consecutive hearing dates for early June 2026.
The former governor will remain in custody as proceedings move forward.
