The Federal High Court in Lagos issued a directive on Wednesday, compelling the Federal Government to regulate the prices of essential goods and petroleum products within a seven-day timeframe. The court’s decision stemmed from a lawsuit (No FHC/L/CS/869/2023) filed by human rights activist Mr. Femi Falana against the Price Control Board and the Attorney-General of the Federation, listed as the first and second defendants. Falana sought clarification on whether the Price Control Board, as the first respondent, was fulfilling its duty under Section 4 of the Price Control Act, which empowers it to impose pricing on specified goods.
The suit also sought a declaration that the failure or refusal of the defendants to regulate the prices of the mentioned goods and petroleum products violated Section 4 of the Price Control Act. During the hearing, Falana informed the court that the motion was based on Section 4(1) of the Price Control Act, filed in May 2023, and despite serving the processes to the defendants, they failed to file any response.
Given the lack of a counter-response, Falana urged the court to grant all the reliefs sought. Justice Lewis-Allagoa, after considering Falana’s submission and citing relevant legal precedents, granted all the reliefs as requested, noting the absence of a counter from the respondents.
In an affidavit supporting the motion, Falana highlighted the Price Control Board’s responsibility to stabilize general price levels, prevent hoarding, and protect customers from exorbitant prices. The second defendant, the Chief Law Officer of the country, was also mentioned in the affidavit. Falana, a prominent human rights advocate, has been actively involved in defending and promoting human rights in Africa for over three decades. The court’s decision now compels the Federal Government to take prompt action in regulating the specified prices within the stipulated seven-day period.
