He commented, “Many of those participating in the elections are voting for the first time, and they believe, whether rightly or wrongly, that their preferred candidate must be declared the winner. I believe this is the driving force behind these developments.”
Falana noted that while election petitions have been a part of Nigeria’s history since the colonial era, the current situation stands out due to the significant level of pressure and intimidation directed at the judiciary.
He emphasized that the judicial process does not end with the Court of Appeal or the Presidential Election Petition Tribunal, as losing parties still have the option to appeal to the Supreme Court. Therefore, he questioned the basis for the ongoing attempts to influence the judicial system.
Falana urged the judges not to succumb to intimidation, emphasizing their responsibility to review the evidence, apply the law, and deliver judgments based on their conviction and legal reasoning.
He reiterated that some parties will win, while others will lose, but those who feel aggrieved by the judgment have the recourse to approach the Supreme Court to challenge any perceived errors made by the Court of Appeal.
