The National Electricity Regulatory Commission (NERC) recently raised the tariff for Band A customers from N68/KWh to N225/KWh. Under this new scheme, Band A customers are promised 20-24 hours of electricity daily, while Band B and Band C subscribers are assured 16-20 hours and 12-16 hours respectively.
However, Falana has lambasted this policy, labeling it as “illegal tariffs.” He argues that neither the Federal Government nor Adelabu have adequately justified the tariff hike. According to Falana, Section 116 of the Electricity Act 2023 mandates a public hearing before any tariff increase, a step that was omitted in this case. He further questions the impunity with which the increase was implemented.
Expressing concern over what he sees as a lack of adherence to the rule of law, Falana has issued a warning to the commission, highlighting their disregard for legal procedures. He criticizes the government’s failure to fulfill promises of uninterrupted power supply as a basis for justifying the tariff hike.
Falana alleges that the Nigerian government is bowing to pressure from international financial institutions like the World Bank and the International Monetary Fund (IMF). According to him, these institutions advocate for the removal of subsidies and the commercialization of essential services, making them unaffordable for the majority of Nigerians. He accuses the Minister of Power of acting in line with these neoliberal policies, prioritizing the interests of international financiers over those of the Nigerian people.
