The Order, which takes effect on August 14, 2024, aims to protect mining communities across all 18 local government areas of the state. It addresses issues such as security, exploitation, and the improper collection of surface rent from mining operations.
Otu emphasized that the Executive Order is necessary to ensure that mining companies and individuals consistently pay surface rent, contributing to safety, peace, and effective governance. According to the Order, all mining entities must secure a Community Consent and Development Agreement, vetted by the Ministry of Justice, to ensure that community development commitments align with the state’s development plan.
The Order also mandates the verification of mining entities and their leases against federal government regulations, in accordance with the 1999 Constitution. Profiling will be conducted in collaboration with the state Commissioner of Police, considering the provisions of the Land Use Act.
The Ministry of Environment will oversee the restoration and repair of affected lands, while the Ministry of Lands will approve physical infrastructure projects by mining entities. Various state ministries and agencies, including Justice, Environment, Mineral Resources, Local Government Councils, Traditional Institutions, and the Cross River State Internal Revenue Service, will work together to enforce compliance, collect surface rents, and prosecute offenders.
Additionally, the Order grants authority for the imposition and collection of surface rents, including specific charges per mineral type and cadastral units. It sets guidelines for payment deadlines and fee remittance to state accounts.
The Cross River State Executive Council will review the Order every three years, ensuring its application aligns with existing and future relevant laws.
