In the final vote, at least 53 senators supported the motion, which was based on five of the eleven charges against Gachagua. These included allegations of improper shareholding, undermining judicial independence, violations of the National Cohesion and Integrity Act, and gross misconduct related to public criticisms of the National Security Intelligence Service. Gachagua’s earlier remarks in June, criticizing the agency for not briefing President William Ruto on mass protests against unpopular tax hikes, were seen as undermining the president’s authority.

The impeachment motion also garnered significant backing in the National Assembly, where 281 Members of Parliament voted in favor of Gachagua’s ouster, while only 44 opposed it, with one MP abstaining. Following the vote, Speaker Kingi announced, “DP Gachagua ceases to hold office.” If Gachagua does not challenge the impeachment in court, this situation would allow President Ruto to nominate a successor, though he has yet to publicly address the matter.
