Human Rights Lawyer and Senior Advocate of Nigeria (SAN), Femi Falana, has voiced apprehensions regarding the implementation of state police across the country. While Falana supports the concept, he emphasizes the necessity for stringent legal safeguards to prevent potential misuse of police forces by certain state governors for political intimidation and oppression.
During an interview on Channels Television’s Inside Sources With Laolu Akande, Falana articulated his concerns, noting the existing decentralization of policing to some extent, with residential areas employing private security firms armed with various weapons for protection.
Falana recognized the timeliness of establishing state police but underscored the need for clear delineation of jurisdictions to prevent conflicts and rivalries among security agencies. He emphasized that the primary focus of state police should be serving the people rather than being excessively influenced by political authorities.
Additionally, Falana highlighted that having a unified federal police force is not contrary to the principles of federalism, as effective management is pivotal for its success. He criticized the tendency of governors to treat the Nigeria Police Force as a tool of the federal government, which has spurred calls for state police.
Referring to Section 216 of the Constitution, Falana pointed out the significance of the Nigeria Police Council, comprising mostly state chief executives, in matters concerning police administration, funding, and management. However, despite its importance, he lamented the council’s lack of convening.
Falana stressed the importance of adhering to constitutional provisions and conducting thorough reviews before implementing state police, emphasizing the need to reassure citizens and prioritize their safety.
Regarding the current situation, Falana warned of the potential for certain governors to exploit state police for oppression, similar to the perceived misuse of federal police. He urged that while decentralization of policing is necessary in a federation, measures must be in place to prevent intimidation or oppression of political opponents at all levels of government.
The issue of state police continues to spark debates, with some governors and regional socio-political groups advocating for their establishment to address rising security challenges such as kidnapping and banditry. Presently, approximately 23 states have their own security outfits, though they encounter operational challenges, including limitations on weaponry.
Despite these challenges, governors remain hopeful that with legal support, these organizations can effectively combat insecurity.
