Addressing the matter, a seven-member panel of Supreme Court justices, chaired by Justice Garba Lawal, has commenced the hearing process. Notably, Yusuf Olaolu Ali and Sebastien Hon, distinguished Senior Advocates of Nigeria (SANs), have volunteered their legal services to support the federal government in this complex legal battle.
In the case with suit number SC/CV/343/2024, the Attorney General of the Federation (AGF) is seeking relief from the Supreme Court, urging an order to restrain state governors from unilaterally, arbitrarily, and unlawfully dissolving democratically elected local government leaders within their jurisdictions. The AGF, in a personally signed originating summons, petitions the Supreme Court to allow the direct allocation of funds held in the credits of local governments from the Federation Account, in line with constitutional provisions, rather than through allegedly unlawful joint accounts established by governors. Additionally, the AGF seeks an order from the Apex Court to prohibit governors from forming Caretaker Committees to administer local governments, which is deemed contrary to the constitutionally recognized democratic system
