The former Attorney General and Commissioner of Justice in Kano State, M.A. Lawan, has clarified the implications of the recent Court of Appeal judgment on the Kano Emirate dispute, reaffirming Aminu Ado Bayero as the legitimate Emir of Kano.....KINDLY READ THE FULL STORY HERE▶
In a statement issued Sunday, Lawan dismissed claims by the Kano State government that the Court of Appeal validated its actions under the contentious Emirate Council Law of 2024.
He explained that the appellate court delivered two separate judgments, which have been misinterpreted.
“One judgment overturned the Federal High Court’s decision on jurisdiction in a suit filed by kingmaker Alhaji Aminu Babba Dan Agundi. The second judgment annulled the Kano State High Court ruling that nullified Bayero’s position and other emirates,” Lawan stated.
He asserted that the court’s decision firmly establishes Bayero’s continued legitimacy while questioning any attempts to reinstall Muhammadu Sanusi II as Emir.
“The Court of Appeal’s judgment affirms that Aminu Ado Bayero’s occupation of the throne remains legitimate, while the alleged attempt to enthrone Alhaji Muhammadu Sanusi II remains legally questionable,” he added.
Additionally, Lawan highlighted an unresolved fundamental rights enforcement case in which Justice Amobeda of the Federal High Court awarded Bayero ₦10 million in damages. This judgment remains unchallenged and valid, as the Court of Appeal has yet to address it.
He urged the Kano State government to avoid misleading the public about the legal outcome and cautioned Muhammadu Sanusi II against presenting himself as the Emir of Kano, emphasizing that no court ruling has endorsed his claim to the throne.
