NAFDAC’s prohibition, initiated in January, aimed to address concerns related to drug abuse, particularly among young Nigerians. Agbodike, leading the debate on the motion, highlighted the constitutional authority vested in the National Assembly by Section 4(2) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), to enact laws for the good governance of the Federation.

Quoting Sections 88(1) and (2) of the Constitution, Agbodike emphasized the National Assembly’s power to investigate activities of entities implementing laws, including NAFDAC. He argued that the ban contradicted the constitution and the Economic Recovery Plan of the current administration.

Expressing concern over the potential economic impact, Agbodike stated that the ban could lead to significant job losses, especially for over 50% of workers in Nigeria. He stressed that, given the economic challenges faced by many Nigerians, the ban could worsen the situation and hinder the sustainability of Small and Medium Enterprises, which employ over 84% of the workforce.

Agbodike cautioned that the ban might encourage illicit production of beverages without NAFDAC oversight. He contended that the prohibition would exacerbate poverty in the country.The motion has been referred to the Committee on NAFDAC for further legislative examination.
